Privacy Policy

  1. We understand how important it is to keep your personal information safe and secure and we take this very seriously. We have taken steps to make sure your personal information is looked after in the best possible way and we review this regularly.

  2. The LivingLite support program (the “Program””) is administered by DKSH Healthcare Australia Pty Limited (ABN 18 649 899 874) (“DKSH”, “we” or “us”) and sponsored by iNova Pharmaceuticals (Australia) Pty Ltd (ABN 13 617 871 539) (“iNova”).

  3. Please read this Privacy Policy carefully as it explains how DKSH handles the personal information that it obtains in connection with your enrolment (if you are a patient) or participation (if you are a patient or healthcare professional) in the Program. Only anonymised and aggregated data will be shared with iNova from DKSH, unless an adverse event is reported (see section 21).

The Australian Privacy Principles

  1. The Privacy Act 1988 outlines the Australian Privacy Principles, which set the minimum standards for how private sector organisations should handle your personal information. We are committed to complying with the Australian Privacy Principles.

Your personal information

  1. “Personal information” includes information about you that identifies you or could reasonably be used to identify you.

  2. (For patients only) The personal information collected and stored by us may include your name, date of birth, address, mobile phone number and email address, sensitive information (see below) and any other personal information which you submit to us, or which others submit to us about you, for the purposes of us administering and managing the Program.

  3. (For patients only) We also hold details of the Program services that you take up or agree to participate in (including their status). If you request a specific service in relation to the Program, we may also collect information from you related to that service, including sensitive information.

  4. (For healthcare professionals only) The personal information collected and stored by us may include your name, address, phone number, practice name and location, AHPRA number and details of your participation in the Program and any other personal information which you submit to us, or which others submit to us about you, for the purposes of us administering and managing the Program.

Sensitive information (for patients only)

  1. We may collect sensitive information about your health status, including information about your weight loss, any goals you have in relation to the treatment or management of your weight loss or your general health or any information provided by you or third parties in relation to health services provided to you.

Consent

  1. By providing us with personal information and sensitive information (as applicable) and by enrolling and/or participating in the Program and using this website, you acknowledge and agree to us collecting, transferring, disclosing, storing, and processing the information in accordance with this Privacy Policy and the terms of any consent you provide.

  2. You can withdraw your consent at any time by contacting us (see section 37).

How we collect personal information

  1. We collect your personal information in a number of ways, including:

    • directly from you, for example, when you provide information during your enrolment or participation or otherwise online;

    • (for patients) from your nominated healthcare professional; and

    • from third parties involved in the delivery of the Program.

How we use your personal information

  1. (For patients only) DKSH uses your personal information primarily to manage your participation in the Program and in accordance with this Privacy Policy. For example, in connection with the Program, your personal information may be used to:

    • enrol or register you for the Program;

    • to ensure your continuing eligibility for the Program;

    • provide you with services in connection with the Program, administer and manage as well as improve or enhance the Program;

    • contact you as necessary regarding matters relating to the Program or to clarify certain aspects of your personal information and/or to review your experience / participation in the Program and your interest in participating in market research in relation to the Program;

    • provide counselling services through the Program;

    • allow us or other parties involved with the Program to gain an understanding of your relevant health information, including medical history, medical conditions and requirements;

    • communicate with third parties involved in the Program;

    • share with iNova (see sections 21 and 22); and

    • comply with laws on the reporting of adverse events and to contact you in relation to adverse health events.

  2. (For healthcare professionals only) DKSH uses your personal information primarily to manage your participation in the Program and in accordance with this Privacy Policy. For example, in connection with the Program, your personal information may be used to:

    • enrol or register you for the Program;

    • provide you with services in connection with the Program, administer and manage as well as improve or enhance the Program;

    • contact you as necessary regarding matters relating to the Program or to clarify certain aspects of your personal information and/or to review your experience / participation in the Program and your interest in participating in market research in relation to the Program;

    • communicate with third parties involved in the Program; and

    • share with iNova and other Third Party Partners (“TPPs“) (see section 23).

  3. (For patients and healthcare professionals) DKSH will not use your personal information for any other purposes unless DKSH has your consent to do so or is required to do so by law.

  4. If you do not provide personal information when requested, you may not be able to participate in the Program.

Contacting you

  1. By enrolling and participating in the Program and using the website, you acknowledge and agree that DKSH may use your personal information to send you SMS, telephone and/or email communications in relation to the Program and the service provided under the Program, including the receipt of reminders and other notifications relating to the Program.

  2. If you do not, or you no longer, wish to receive such communications, you may opt out of the receipt of SMS and/or emails or the whole program at any time by contacting DKSH (see section 38). DKSH will comply with your request as soon as practicable.

When we disclose your personal information

  1. We may disclose your personal information to organisations outside of DKSH (which may include TPPs as set out in section 23) in connection with the provision and administration of the Program, including (but not limited to) allow those organisations to provide or assist with:

    • patient enquiries;

    • mailing operations;

    • healthcare services (e.g. health coaches, nurse telephone support etc.);

    • information technology services; and

    • market research.

  2. Your personal information is disclosed to these organisations only in accordance with this Privacy Policy and any consent which you provide to us.

Data Sharing with iNova (for patients)

  1. Any self-reported adverse events that arise from taking your iNova medication for weight loss will be reported to iNova for the purpose of reporting this information to the appropriate regulatory notification body and/or in accordance with iNova’s adverse event reporting processes. iNova may also use the personal information to contact you to obtain additional information relating to your adverse event.

  2. Otherwise, aggregated, de-identified information relating to your participation in the Program, such as information about your goals and tracking, will be collated into a report for iNova. iNova may use this information for internal purposes, including planning and managing resources for the Program, and analysis and research purposes (e.g. to calculate patient adherence rates and improve health outcomes). iNova may disclose such information to third parties in order to promote awareness of the Program and to publish the information in reports or medical publications. However, you will not be able to be identified in any form of report or publication. Any personal information collected by iNova will be handled in accordance with iNova’s privacy policy available at https://inovapharma.com/privacy/.

Data Sharing with iNova &TPPs (for healthcare professionals)

  1. Personal information / healthcare provider information and/or healthcare professional information (which may include but is not limited to name, address, phone number, practice location, AHPRA number and details of participation in the program) associated with the Program may/will be shared with TPPs of iNova for the purposes of (which may include, but are not limited to) conducting research and analysis, identifying products or services that may be of interest, informing and sending marketing communications and/or any other uses as iNova deems necessary.

  2. If your personal information and/or healthcare provider information and/or healthcare professional information is not provided to a TPP, the TPP will not be able to conduct research and analysis, identifying products or services that may be of interest, consider and send marketing communications. A TPP may share your information with other third parties.

  3. By participating in the Program and using the website, you acknowledge and agree to the disclosure of and the collection and use of your personal information and/or healthcare provider information and/or healthcare professional information to a TPP (which may also include iNova).

Help us to ensure we hold accurate information

  1. We take all reasonable precautions to ensure that the personal information we collect, use and disclose is accurate, complete and up- to-date. However, the accuracy of that information depends to a large extent on the information you and others provide to DKSH, so we ask that you:

    • let us know if there are any errors in your personal information; and

    • keep us up-to-date with changes to your personal information such as your email or phone contact details. If you are a subscriber to one of our online products or services, you may change these above-mentioned details by using the relevant facility on our websites.

Security and retention of your personal information

  1. We may hold your personal information in a number of ways, including electronically and in paper format. DKSH takes reasonable steps to protect such personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Personal information that we hold on our systems is protected through the use of secure passwords and other security procedures.

  2. We also maintain physical security procedures to manage and protect the use and storage of paper records containing personal information.

  3. Access to personal information is limited to those personnel who specifically need it to conduct their business responsibilities for the purposes of the Program.

  4. We educate our personnel about the requirements of the Australian Privacy Principles and the Privacy Act, and require that they handle personal information in accordance with them.

  5. We will keep your personal information as required in connection with the administration and management of the Program. We will take reasonable steps to destroy or permanently de-identify personal information when we no longer need it.

You can access and correct your personal information

  1. You have a right to access and ask us to correct your personal information, subject to some exceptions, as prescribed by law. If you would like to do so, please let us know. You may be required to put your request in writing for security reasons. We reserve the right to charge a reasonable administration fee for searching for and providing access to your information.

Use of cookies

  1. Our websites use “cookie” technology to obtain non-personal information from online visitors, and also to provide registered visitors with the best possible personalised online experience.

  2. If you don’t want cookies, you can set your computer to warn you each time a cookie is being sent and to turn off all cookies through your browser.

If you have a complaint

  1. If you have any complaints about our privacy practices or procedures, we ask that you contact us in writing using the details below. We will promptly acknowledge and investigate complaints.

  2. If you do not receive a response to your request in a timely manner or are otherwise unsatisfied with our handling of your request, you may lodge a complaint with The Office of the Australian Information Commissioner. Details of how to make a complaint are located at http://www.oaic.gov.au/.
